Solar construction-tax relief

Ayuntamiento de Rivas VaciamadridSpagna

Taxpayers installing their first solar photovoltaic system for self-consumption in an existing Rivas Vaciamadrid building can reduce the ICIO construction tax on eligible solar works by 50%.

Questa opportunità è attualmente disponibile in inglese.

The relief reduces the Impuesto sobre Construcciones, Instalaciones y Obras (ICIO), the municipal tax on construction and installation works. It applies only to the part of the gross tax charge attributable strictly to qualifying solar works.

ICIO is charged at 4% of the tax base: the cost of physically executing the works. VAT and similar taxes, local charges, professional fees and the contractor’s business profit are excluded. For minor works, the ordinance uses the greatest applicable base, including its solar-panel reference module of €664 per square metre of panel and the submitted works budget; municipal estimates apply where needed. The initial payment is provisional and the municipality reconciles it against the actual final cost, collecting or returning the difference.

You may apply the relief directly in the provisional tax self-assessment. If municipal technical checks later find that the planned or completed works fail the planning or tax requirements, the municipality will cancel the relief and recover the benefit, plus any applicable late-payment interest.

Eligibility

  • The works must be in Rivas Vaciamadrid. The ICIO taxpayer is the person, legal entity or tax-law entity bearing the works cost, whether or not they own the property. If someone else files the licence application, responsible declaration or prior notice, or carries out the works, they may be the substitute taxpayer and recover tax paid from the person bearing the cost.
  • The building must already be constructed and have a valid first-occupation licence, or the authorising title replacing it. The photovoltaic system must be installed for the first time and supply electricity for self-consumption.
  • Under the ordinary building rule, installed capacity must be at least 4 kW for the first 300 m² of built area recorded by the Cadastre, increasing by 4 kW for each additional 100 m² or fraction, with a maximum of 100 kW.
  • For existing collective buildings with units arranged on multiple floors under the horizontal-property regime, where separately owned dwellings or premises share the building, the alternative requirement is at least 1.5 kW for each dwelling or premises connected to the first installation. It may serve all or some units, and combined installed capacity must not exceed 100 kW. The same valid first-occupation licence or replacement title is required.
  • Solar systems forming part of the same project or planning file as a new building are excluded.

How to apply

  • Request the solar relief within ten days after filing the required responsible declaration or replacement authorising title.[^c6]

Use the municipal virtual tax office’s “Simulador del Impuesto Obras (ICIO)” to prepare and pay the tax self-assessment. You may apply the solar relief provisionally. Submit the paid ICIO self-assessment and corresponding fee through the municipal incoming registry before processing the Declaración Responsable, the declaration identifying the planned works for municipal compliance checks.

Within ten days after submitting that declaration, or its replacement authorising title, the taxpayer must request the relief through the Registro de Entrada using the specific municipal form. Attach a copy of the submitted declaration, copies of the paid fee and ICIO self-assessments, and the technical design memorandum signed by an authorised installer and registered with an Entidad de Inspección y Control Industrial (EICI), an industrial inspection and control body.

The municipal procedure provides electronic filing with DNIe, a digital certificate or Cl@ve. Legal persons, entities without legal personality such as owners’ associations, and representatives of those required to file electronically must use electronic means. Other applicants can book a citizen-service registry appointment online or at 91 670 00 00 or 010. Gestión Tributaria handles the request.

When the works finish, declare their actual cost for the final tax reconciliation. An approved project change that increases the budget requires a supplementary self-assessment. If works have started without the required licence, the tax self-assessment must be paid within one month of starting; payment does not itself authorise the works.
