Solar construction-tax relief
People and entities paying for voluntary solar installations in Málaga can reduce the construction tax on qualifying works by 95%.

ICIO (Impuesto sobre Construcciones, Instalaciones y Obras) is the municipal tax on construction, installations and works requiring a municipal works licence, a responsible declaration (your formal declaration that the work meets the rules) or prior notice. The solar relief reduces the tax attributable to qualifying self-consumption works—solar energy for your own use.
The normal ICIO rate is 3.8% of the material execution cost: the actual cost of carrying out the works, excluding VAT and similar taxes, related municipal charges, professional fees and the contractor's business profit. The 95% relief applies to the part of the tax bill strictly attributable to the eligible solar works, rather than reimbursing 95% of the installation price.
Where an Article 7 reduction also applies, the solar reduction is calculated on the remaining tax liability. Combined reductions cannot exceed 100% of the tax. The ordinance caps discretionary reductions at €300,000 per construction, installation or works project, including projects built in phases; the separate Article 7.1 and 7.8 exceptions do not remove this cap for a standalone solar claim.
Eligibility
- The installation must be in Málaga municipality. The applicant is the person or entity who bears the works cost, whether or not they own the property. The ordinance covers individuals and entities who bear that cost.
- The solar installation must be for self-consumption and must not be required by the applicable regulations.
- Solar hot-water systems must have at least 5 kW of power, counting solar and backup energy. Heat-producing installations must use collectors approved by the competent administration. Provide proof that the Junta de Andalucía's provincial authority has approved commissioning—putting the installation into operation.
- Photovoltaic systems must be connected to the electricity distribution grid, with an approval document from the competent authority.
- At application, all municipal liabilities whose voluntary payment period has ended must be paid. You must also have direct debit set up for any periodic municipal taxes for which you are liable, through a bank with a branch in Spain.
- Comply with municipal tax duties: pay amounts due, submit required tax declarations or changes with taxpayer and representative identification, declare your tax or administrative address, keep legally required accounting and other records available, and allow inspections and supply relevant information.

Apply to Málaga City Council through the live solar ICIO procedure in the Sede Electrónica, an OMAC municipal citizen-service office or the council's General Registry. Submit the benefit request before the construction, installation or works are completed.
Prepare a reasoned budget identifying the cost of qualifying works, a detailed installation invoice and a certificate that the solar installation is not legally compulsory. The ordinance requires these documents to be signed by a qualified technician and endorsed by the relevant professional college. Include the applicable commissioning or installation approval. If required documents cannot be supplied until completion, provide them during the council's definitive cost check; this does not extend the deadline for requesting relief.
ICIO becomes chargeable when work starts, even without the required licence or declaration. A provisional assessment—an initial tax bill subject to later adjustment—is made when the licence is granted, the responsible declaration or prior notice is filed, or unlicensed work starts. It uses the submitted budget when the required professional endorsement is present; otherwise the ordinance's valuation modules apply, or the budget if the modules cannot be used. A self-assessment is a tax calculation filed by the taxpayer: filing one without payment does not cancel the debt, including when a payment deferral or instalments have been requested.
For the claim deadline, works are treated as completed when the execution period in the licence, declaration or prior notice expires. If no period is stated, completion is deemed six months after licence issue or filing of the declaration or notice. A granted extension or evidence in the file of a different completion date can change this.
After completion, the municipal tax body checks actual costs and issues a definitive assessment, requiring additional payment or returning the appropriate amount. When requested, submit the completion declaration and cost evidence, including the final budget, invoices or works certificates, execution contracts and other applicable records. The council may apply requested relief provisionally and adjust it if the claim is later refused. A refund of provisional tax resulting from the relief does not count as an undue payment for interest purposes.
The decision period is six months. If no decision is issued in that period, the request is treated as refused.
